Rental housing with a buyout

Program conditions

Within the framework of the Housing and Communal Infrastructure Development Concept 2023-2029 (approved on September 23, 2022 No. 736), Kazakhstan Housing Company JSC continues to implement the direction of providing rental housing with purchase.

Rental housing with redemption is sold to the waiting lists of local executive bodies and employees of state/non-state legal entities with whom the relevant agreements have been concluded, under the following conditions:

  • The lease term with redemption is up to 20 years;
  • Without a down payment;
  • The possibility of attracting guarantors in case of insufficient income;
  • Upon expiration of the lease period, the housing becomes the property of the tenant;
  • The possibility of early purchase of housing before the end of the lease term.

List of documents and their consideration

If there is housing for sale under the lease-to-buy program, Kazakhstan Housing Company JSC sends a letter to state/non-state legal entities with which relevant cooperation agreements have been concluded, and information on the housing being sold, to form lists of applicants.

The lists formed based on the results of work with state/ non-state legal entities are sent to JSC “Kazakhstan Housing Company” to determine solvency.

The distribution of housing among the participants of the program is carried out in an automated mode on the website of JSC “Kazakhstan Housing Company”, where participants independently select and book housing (apartments).

1. How can I repay the loan ahead of time?

Repayment terms for mortgage borrowers:

In case of partial early repayment

  1. The client must apply to the KHC with a statement of the established sample, indicating the amount of early repayment.
  2. Deposit the specified amount to your account on the day of sending the application.
  3. After the call from the credit manager confirming the approval of the application, visit the Company's office to sign a new payment schedule.

With full early repayment

  1. The client needs to specify the amount for full repayment, as well as the amount for processing the application.
  2. Deposit money to your personal account.
  3. Send a standard application to the KHC.
  4. After calling the loan manager, visit the Company's office to obtain the title documents for the property. 

Attention! For clients living in the regions, the deadline for signing a contract for the transfer of a real estate object to ownership, as well as receiving original documents, can range from 3 to 7 working days, depending on the location of the region.

In case of partial early repayment

2. Who can participate in the Housing construction Program "Nurly Zher" in the direction of "Rental housing with purchase of "KHC" JSC:

Rental housing with foreclosure is sold to waiting lists registered with LEB, in the order of priority determined in accordance with the current housing legislation of the Republic of Kazakhstan, for the following categories:

  • large families;
  • single-parent families;
  • families with or raising disabled children;
  • orphaned children, children left without parental care;
  • oralmans;
  • disabled people of groups 1 and 2;
  • civil servants, military personnel, employees of special state bodies, employees of budgetary organizations.
  • At the same time, 50% of housing is sold to persons from the above categories who have been married for at least 3 years, have children (child), and both spouses are under 35 years old (at the time of applying for participation in the Program), as well as single-parent families in which the children (child) are raised by one from parents who have not reached the age of 35, including divorced, widowed.
3. What is the age category of participants in the Housing Construction Program "Nurly Zher"?

The local executive body (LEB) is responsible for taking into account waiting lists.

4. When will the acceptance of documents for the Housing Construction Program "Nurly Zher" begin?

The deadlines for accepting documents are determined by LEB. Announcements about the start of accepting applications for Housing construction program "Nurly Zher" they are posted on the websites of the LEB (akimats).

5. What documents do I need to submit to undergo a solvency assessment?
  1. Originals (for verification)  and copies of the identity cards of the Applicant and the Guarantor;
  2. A document confirming registration at the permanent place of residence (address certificate) of the Applicant and the Guarantor;      
  3. Originals of certificates from the place of work of the Applicant and the Guarantor about the position, work experience;
  4. Originals of salary certificates from the place of work of the Applicant and the Guarantor, for the last six months preceding the month of submission of documents;
  5. Originals and copies of documents confirming other income of the Applicant and the Guarantor for the last six months preceding the month of submission of documents;
  6. Original statements of pension contributions of the Applicant and the Guarantor for the last six months preceding the month of submission of documents;
  7. The original and a copy of the marriage certificate, divorce certificate, death certificate of the spouse (if there is a spouse);
  8. Originals and copies of children's birth certificates (if there are children).
6. Can citizens who are already in line at the Housing Department under another state program participate in this program? Or do I have to re-collect the documents and get in line?

According to the terms of the Program, citizens who are registered with LEBas needing housing from the public housing stock or housing rented by LEB from a private housing stock are allowed to participate in the Program. For more information, please contact LEB.

7. What kind of registration should I have?

Among the documents provided for inclusion in the list of participants of the Program, it is necessary to provide a document confirming registration at permanent residence (address certificate or certificate of rural and/or aul akimats). LEB employees are responsible for checking registration/registration.

8. When will it be possible to buy a house?

A lease with a purchase provides for:

  • The lease term with the purchase is 20 years;
  • Upon expiration of the lease period, the housing becomes the property of the tenant;
  • Early purchase of rental housing is allowed.
  • Alienation of housing is not allowed within two years from the date of its acquisition by a participant of the Program into ownership under purchase and sale agreements, except in cases of sale of mortgaged housing in a compulsory extrajudicial procedure or by court decision in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan.

Measures to resolve problem debts

  1. Conditions and procedure for debt settlement and measures applied to an insolvent borrower/tenant/buyer

In case of formation of overdue debt on obligations, the borrower /tenant/buyer has the right to apply to the company with an application for debt restructuring.

The restructuring of overdue debts under lease agreements with redemption/purchase and sale agreements of real estate with installment payment is carried out in the following ways:

    1. write-off of penalties accrued for late fulfillment of obligations under the lease agreement;
    2. amortization of rent arrears;
    3. provision of deferred payment of lease payments;
    4. change in the period of restoration of the guarantee fee;
    5. conclusion of an agreement on the settlement of a dispute (conflict) by way of mediation.

The restructuring of overdue debt under mortgage agreements with repurchase is carried out in the following ways:

    1. amortization of overdue debts for a period of 3 to 36 months or until the end of the contract;
    2. restructuring of the loan by granting a deferral;
    3. transfer of debt obligations/renewal of ownership;
    4. assignment of the rights of claim on the problem loan to third parties;
    5. accrual/reversal/write-off of interest on problem loans;
    6. other ways of restructuring problem loans that are not prohibited by the legislation of the Republic of Kazakhstan and internal documents of the Company.
  1. Measures taken by the company in case of non-fulfillment by the borrower/tenant/buyer of the requirements

In accordance with the norms of the current legislation of the Republic of Kazakhstan and the terms of contracts, in case of non-fulfillment and/or improper fulfillment of the obligations of the borrower, the company has the right in accordance with the established procedure:

    1. apply to a notary for the execution of an executive inscription;
    2. apply to the court with a statement of claim for termination of the contract, debt collection and eviction of the tenant (and persons living together with him);
    3. to make a non-acceptance and indisputable withdrawal of money from any bank accounts of the borrower to repay the debt;
    4. apply any measures provided for by the legislation of the Republic of Kazakhstan and (or) the terms of the contract, including changing the terms of the contract, file a lawsuit to recover the amount of debt under the contract, as well as foreclose on mortgaged property out of court (except for cases provided for by the legislative act of the Republic of Kazakhstan on mortgage of immovable property property) or in court.
