On November 26, 2021, a guarantee agreement was signed between JSC “Kazakhstan Housing Company” and LLP “Atyrau Zh.B.I.-2005”, LLP “MBS Capital” for the project “Construction of four 9-story residential buildings in the Nursaya microdistrict in Atyrau.” According to the agreement, the project was to be commissioned no later than September 1, 2022.
Based on requests from LLP “MBS Capital” and in accordance with the Law of the Republic of Kazakhstan “On Participation in Shared Construction of Housing,” the Unified Operator approved the extension of the construction deadlines three times (from September 1, 2022, to June 1, 2023).
By the end of the extended deadlines, construction and installation work on the project was not completed, and the project was not ready for commissioning.
“In accordance with subparagraph 1) of paragraph 3 of Article 37 of the Law of the Republic of Kazakhstan ‘On Participation in Shared Construction of Housing,’ upon establishing the occurrence of a guarantee case, the Unified Operator on June 20 of this year made a decision to recognize and declare the guarantee case for the project ‘Construction of four 9-story residential buildings in the Nursaya microdistrict in Atyrau.’
Currently, to fulfill its obligations to the shareholders under the shared construction guarantee agreement, the Kazakhstan Housing Company has commenced the necessary measures to resume and complete the construction of the project as soon as possible.
The JSC “Kazakhstan Housing Company” has sufficient funds to complete the construction of this project. The fourth section of the four 9-story residential buildings is planned to be completed by the end of this year, and the second section — by the end of the first half of 2024,” — commented Olzhas Zholdasbayev, First Deputy Chairman of the Management Board of JSC “Kazakhstan Housing Company.”
