JSC "Kazakhstan Housing Company" (whose sole shareholder is JSC "National Managing Holding Baiterek," hereinafter referred to as the Unified Operator) hereby informs.
On August 27, 2022, a guarantee agreement No. DPG-22-16-055/120 was concluded with LLP "VVD-Kurylys" and LLP "Sparkle Diamond" for the project "Construction and placement of a multi-storey residential building with commercial premises located at: Ust-Kamenogorsk, 19th residential district, at the intersection of Yu. Uvaliev and Kokzhal Barak streets (excluding external engineering networks)" (hereinafter referred to as the Object). According to the Agreement, the commissioning date of the Object is no later than August 10, 2024.
In accordance with subparagraph 1) of paragraph 3 of Article 37 of the Law of the Republic of Kazakhstan "On Equity Participation in Housing Construction," in the event of establishing a warranty case, the Unified Operator shall make a decision to recognize it as a warranty case within three working days if the commissioning of the multi-storey residential building is delayed. Three extensions of the construction period, each for three months, are allowed from the date specified in the design (project-estimate) documentation of the construction project.
At the same time, based on requests from LLP "Sparkle Diamond," the Unified Operator approved one extension of the construction period (from May 10 to August 10, 2024).
As of today, construction and installation works at the Object have not been completed, and the Object is not ready for commissioning.
For the purpose of completing the construction of the multi-storey residential building and fulfilling obligations to equity holders under the guarantee agreement for equity participation in housing construction, JSC "Kazakhstan Housing Company" declares the occurrence of a warranty case for the project "Construction and placement of a multi-storey residential building with commercial premises located at: Ust-Kamenogorsk, 19th residential district, at the intersection of Yu. Uvaliev and Kokzhal Barak streets (excluding external engineering networks)."
JSC "Kazakhstan Housing Company" will proceed with the necessary measures to resume and expedite the completion of construction of the Object.
