Requirements for Obtaining a Guarantee

To obtain a guarantee from JSC “KZhK” for the construction of low-rise residential buildings (up to 5 floors) and a complex of individual residential houses (a cottage town consisting of at least 50 houses), the Developer must meet the following requirements:

For the construction of low-rise residential buildings (up to 5 floors):

Have experience in completed construction projects of multi-apartment residential buildings, including as a customer, contractor (general contractor), or in total, for at least two years, with a total area of at least ten thousand square meters when building in cities of republican significance and the capital, and at least five thousand square meters when building in other administrative-territorial units.

For the construction of a complex of individual residential houses (a cottage town consisting of at least 50 houses):

Have experience in completed construction projects of multi-apartment residential buildings and/or a complex of individual residential houses, including as a customer, contractor (general contractor), or in total, for at least two years, with a total area of at least ten thousand square meters when building in cities of republican significance and the capital, and at least five thousand square meters when building in other administrative-territorial units.

Have assets amounting to at least 10% of total assets remaining after deducting short-term and long-term liabilities for the last two financial years, according to its audited financial statements.

The ratio of borrowed funds to equity must not exceed seven during the entire period of construction of the multi-apartment residential building until it is commissioned.

The Authorized Company must have:

A title document for the land plot owned under the right of temporary paid land use (lease) granted by the state, or under the right of ownership.

Design and estimate documentation for the construction project with a positive conclusion of a comprehensive non-departmental expert review (from January 1, 2025, the design documentation must include solutions for engineering networks, landscaping, and greening. If the project is divided into phases and launch complexes, including for staged commissioning, the cost of phases and launch complexes must be indicated in the expert review conclusion).

Own funds or unfinished construction in the amount of:

at least 10% of the project cost when owning the land plot;

at least 15% when holding the land plot under lease.

Funds to pay the commission for document review and the guarantee fee.

A construction contract for the project.

To obtain a guarantee for the completion of construction and attract funds from equity holders, the Developer and the Authorized Company submit to JSC “KZhK” an application with a package of documents for the construction project.

If the decision is positive, a tripartite agreement on the provision of the guarantee is concluded between JSC “KZhK”, the Developer, and the Authorized Company. From the moment the agreement is concluded, the Developer has the right to sell equity shares in the project by entering into shared-construction agreements with citizens of the Republic of Kazakhstan. Each agreement is subject to mandatory registration in the “Kazreestr” information system.
