Requirements for Obtaining a Guarantee

To obtain a JSC "KHC" guarantee for the construction of low-rise residential buildings (up to 5 floors) and complexes of individual residential houses (cottage settlements consisting of at least 50 houses), the Developer must meet the following requirements:

  • For the construction of low-rise residential buildings (up to 5 floors): have experience in completed multi-apartment residential construction projects, including as a client, contractor (general contractor), cumulatively for at least two years, with a total area of at least ten thousand square meters when building in cities of national significance and the capital, and at least five thousand square meters when building in other administrative-territorial units;
  • For the construction of a complex of individual residential houses (a cottage settlement consisting of at least 50 houses): have experience in completed construction projects of multi-apartment residential buildings and/or complexes of individual residential houses, including as a client, contractor (general contractor), cumulatively for at least two years, with a total area of at least ten thousand square meters when building in cities of national significance and the capital, and at least five thousand square meters when building in other administrative-territorial units;
  • have assets amounting to at least 10% of total assets remaining after deducting short-term and long-term liabilities, for the last two financial years according to financial statements confirmed by an audit report;
  • the debt-to-equity ratio must not exceed seven throughout the entire construction period of the residential building until its commissioning.

The Authorized Company must have:

  • a title document for the land plot held under the right of temporary paid land use (lease) granted by the state, or under the right of ownership;
  • design and estimate documentation for the construction project with a positive conclusion of the comprehensive non-departmental expert review (from January 1, 2025, design and estimate documentation must mandatorily include solutions for engineering networks, landscaping, and planting. Where the project is divided into phases and commissioning complexes, including for phased commissioning, the cost of each phase and commissioning complex must be specified in the expert review conclusion);
  • own funds or unfinished construction in the amount of:
    • at least 10% of the project cost where the land plot is owned;
    • at least 15% where the land plot is leased;
  • funds to cover the document review commission and the guarantee contribution;
  • a construction contract for the construction project.

 

To obtain a completion guarantee and attract equity participants' funds, the Developer and the Authorized Company submit an application to JSC "KHC" with a package of documents on the construction project.

Upon a positive decision, a tripartite guarantee agreement is concluded between JSC " KHC", the Developer, and the Authorized Company. From the moment the agreement is signed, the Developer is entitled to sell shares in the project by concluding residential construction equity participation agreements with citizens of the Republic of Kazakhstan. Each such agreement is subject to mandatory registration in the "QAZREESTR" information system.
